ALABAMA Ph: 334-242-9612 Dealers must obtain a Regulatory Permit from the Sales, Use & Business Tax Division. The permit must be presented to the county license issuing official for issuance of a Privilege License and license plate, and the Taxpayer Service Center for tag issuance.

Categories of Regulatory Licenses:

New Car Dealer, Used Car Dealer, Dismantler, Wholesaler, Rebuilder, Reconditioner.

Dealers must fulfill the following requirements:

a. provide evidence that motor vehicle held for resale are covered by a blanket liability insurance policy b. display a sign designating the place of business c. describe and insure permanency of the place of business d. provide display area for one or more vehicles and a place for maintaining books and records.

Motorcycle and trailer dealers are exempt from regulatory permit. Licenses are renewed annually in person or by mail.

ARIZONA Ph: 602-712-6838 The state assigns a permanent four-digit code for new and used vehicle dealers. Renewal is annual.

ARKANSAS Ph: 501-681-8600 Dealers must obtain a license certificate from the Arkansas State Police (ASP). The used motor vehicle dealer must submit the ASP certificate to an Arkansas State Revenue Office and purchase used motor vehicle dealer license plates. Master license plates are $100.00 annually. Extra dealer license plates are $25.00 each, annually.

CALIFORNIA Ph: 916-657-8871 All dealers must be licensed with the State. A dealer number and corresponding dealer plates are issued. Dealer License Fee: $150.00 application $100.00 renewal New auto, commercial and motorcycle dealers must also pay the New Motor Vehicle Board a $225.00 fee.

COLORADO Ph: 303-205-5604 All car, truck, motorcycle and trailer dealers must be licensed to conduct business in the State. A license is not required for boat, special mobile equipment and off-road vehicle dealers. Applications must complete an application, submit a financial statement, post bond, pass a written exam, have an approved business location and submit to criminal background investigation. Licenses must be renewed annually; fees are adjusted annually.

CONNECTICUT Ph: 860-263-5056 New and used vehicle dealers, manufacturers, repairers, wrecker services and junkyards must be licensed. New vehicle dealers must be franchised by a licensed manufacturer. License issuance is subject to initial approval of local authorities. Upon approval, an application is submitted to the Dealers and Repairers Division of the Department of Motor Vehicles. Applications must be renewed biennially.

DELAWARE Ph: 302-744-2503 Private individual may sell four vehicles per year before being required to become a licensed dealer. All dealers must be licensed by the state by Division of Revenue through the Division of Motor Vehicles. Application must include the franchise agreement. Prior to the issuance of a license all dealer facilities must be inspected by a division representative (no inspection fee).

Dealer License Fee:

$100.00 upon application and renewal. Must be paid to the State Division of Revenue.

DISTRICT OF COLUMBIA Ph: 202-727-5000 Dealers must be licensed to sell vehicles in the District. License is required for new and used vehicle dealers, and a license is required for salesmen. Licenses are issued by the Department of Consumer Regulatory Affairs. An investigation is performed prior to the issuance of dealer and salesmen licenses.

FLORIDA Ph: 850-488-4958 Motor vehicle dealers must be licensed. Individual or business selling 3 or more vehicles in one year must have a dealer's license. Licenses are renewed annually.

Dealer types: Franchise, Independent (Used), Wholesale, Auction, Mobile Home and Recreational Vehicles.

Applicants for a Franchised Dealer License must present a sales/service agreement and appointment letter or letters of intent from the manufacturer or distributor. All dealers must submit fingerprint cards upon initial application for a dealer's license.

GEORGIA Ph: 404-656-2282 A Dealer License may be required for new vehicle dealers. Issuance is handled by each municipality. Leasing Companies and Independent Dealers who deal in used vehicles must be registered with the Used Car Dealers and Sales Tax Division. Mobile Home Dealers must be registered with the Fire Marshal's Office. Mo­torcycle Dealers and Trailer Dealers are not required to be registered.

HAWAII Ph: 808-586-3000 New and used vehicle dealers must be registered. Registrations are issued by the State of Hawaii , the Department of Commerce and Consumer Affairs, and the Motor Vehicle Industry Licensing Board. Dealers must be franchised to sell new vehicles.

IDAHO Ph: 208-334-8681 New dealers must submit an application and present the franchise letter from the manufac­turer. (See Dealer/Salesman's license, Exhibit "D"). New Dealer Code - permanent three-digit number issued. Dealer plates and numbers may be transferred upon sale of the dealership. Used Dealer Code - permanent four digit number issued. Motorcy­cle, ATV, and snowmobile dealer requirements (new and used) are the same as for other dealers. All “used only” dealer applications must pass a written open book test. All renewing used dealers must attend 4 hours of continuing education during the previous year. Dealer's license must be displayed. All applications are investigated.

ILLINOIS Ph: 217-782-7817 All dealers must be licensed. Dealer establishment must be inspected prior to licens­ing. New dealers must present a franchise letter and all dealers must obtain a tax number issued by the Department of Revenue.

New or Used Vehicle Dealer License Fees:

$1000.00 for Certificate of Authority $500.00 for each additional establishment

INDIANA Ph: 317-591-5307 Vehicle Dealer: Must be licensed. Dealer must have a lot, a building not attached to or part of a residence, a display area for at least ten vehicles, a permanent sign with name and hours displayed, garage lia­bility insurance in prescribed limits, and retail merchant certificate number. All classifications of dealers, except whole­salers, must sell at least twelve vehicles per year. Upon application the dealer must present proof of insurance, a photograph of the place of business, and the franchise agreement (required only for new vehicle dealers upon initial ap­plication).

Salvage License: Issued for recyclers, crushers, rebuilders and used parts dealers. Dealer must have three or more inoperable vehicles on the lot. A Salvage License does not grant reassignment privileges. Salvage operators cannot be issued dealer plates unless they meet the required dealer qualifications.

Fee: $ 10.00 annually

Transfer Dealer: Sale of vehicles is incidental to the business. Transfer dealers have restricted dealer plate use.

Fee: $20.00 annually

Whole­saler: Issued for a dealer that sells at least 120 wholesale vehicles per year with no retail sales.

IOWA Ph: 515-237-3163 Motor vehicle dealers, mobile and manufactured home retailers, and travel trailer dealers must obtain a dealer license to conduct business. Licenses are issued by the Office of Vehicle Services, on a staggered system; issued for 2, 4 or 6 year periods. All applicants for a dealer license must have a place of business with a telephone installed and listed in the dealer's name. Motor vehicle dealers must have a repair and display facility and an on-site inspection.

Dealer License Fees: Dealers, travel trailers and mobile or manufactured homes:

KANSAS Ph: 785-296-3626 New and used vehicle dealers must be licensed and issued a dealer number. Individ­uals or businesses selling over 5 vehicles in one calendar year must be licensed as a dealer. Manufacturers of vehicles must also be licensed.

New vehicle dealers require franchise agreement and an inspection of location(s), which must be zoned commercial, be­fore license is issued.

KENTUCKY Ph: 502-564-3750 Automobile, truck and motorcycle dealers must be licensed with the state. Trailer dealers are not licensed. Dealer must have an established place of business and a business name which identifies them as a motor vehicle dealer.

Annual fee: $100.00

All dealers must have at least one licensed salesperson for each location for which a license was issued. Use tax must be paid for all new vehicles sold.

LOUISIANA Ph: 877-368-5463 Dealers must be licensed by the State. Upon application, new vehicle dealers must submit the franchise agreement. Used vehicle dealers cannot sell new vehicles. Any person who sells five or more used vehicles in any twelve-month period must be licensed as a used motor vehicle dealer.

MAINE Ph: 207-624-9000 ext. 52143 A license is required for new and used vehicle dealers. An individual or business sell­ing more than 5 vehicles in a 12-month period, displaying 3 or more vehicles within a 30 day period or buying vehicles for purpose of resale, qualifies as a dealer in Maine . Application is submitted to the Bureau of Motor Vehicles. The applica­tion must provide the following information: size and location of the lot; the size of the building, display, office and re­pair area. Applications must be signed by all parties and witnessed. The building lease must be valid for at least one year.

Dealer License Fees:

$150.00 filing fee and $150.00 licensing fee (both fees required upon application and renewal) $150.00 annual renewal

MARYLAND Ph: 410-768-7536 Motor vehicle dealer must be licensed if he has sold more than 5 vehicles during a year. Dealer must have a location approved by an authorized representative of the MVA and must complete an applica­tion to be approved by the Business License & Consumer Services Division of the MVA, and must submit a bond in the name of the dealership. Laminated dealer photo license issued; annual renewal by mail is required.

$500.00 New and Used Dealer $300.00 for boat trailer dealers and trailers 15 feet or less

MASSACHUSETTS Ph: 617-351-9272 Required for persons principally engaged as dealers (see class listing for specific re­quirements). Dealers must have a separate business office on the premises, maintain a Used Car Record Book approved by the Registry of Motor Vehicles, and post a sign displaying the type of business. Watercraft dealers must have a fran­chise letter from the manufacturer, a sign indicating the type of business and a separate place of business. Dealer Li­censes are issued from the local City Hall; the Boston Police Department issues licenses for dealers based in the city of Boston .

Licenses are issued for the following dealer classes:

Class I - New and/or used vehicle dealer (business license required). Class ll - Used vehicle dealer (business license required). Class lll - Salvage parts/Junk (business license required).

Owner/Contractor - Must have ten vehicles (one of which is special mobile equipment - SME), and garage to work in (business license required). Owner/contractor plates may be issued to: government agencies for public safety uses; persons engaged in leasing storage or mobile office trailers; persons engaged renting or leasing vehicles or trailers to the public (fleets of 20 or more).

MICHIGAN Ph: 517-373-9081 An individual selling five or more vehicles in a year is considered a dealer and must be licensed. Annual dealer license shows the dealer's classification.

MINNESOTA Ph: 651-296-2977 All dealers must be licensed. New and used vehicle dealer licenses must have a per­manently enclosed commercial building on a permanent foundation, office space for records. Personal franchise agree­ment and means for repairing vehicles required for new dealers only. Used vehicle dealers must have a person to answer the telephone or an answering machine. Lessors and wholesale dealers must have an office, records and a person to an­swer the telephone or an answering service. Auctioneer requirements are the same as for new or used dealers, but may be based outside the state. A site inspection is required for all dealers prior to the approval of a dealer license. Dealer classes include new, used and broker, lessor, parts, scrap metal, wholesale, leasing, and auctioning. Boat, snowmobile and motorized bicycle dealers are required to be licensed.

MISSISSIPPI Ph: 601-923-7200 Applicants must have a place of business, an office, and must display a sign, and must file a bond with the application. An eleven digit designated agent number is assigned to each dealer. The number is carried on any issued title and in the dealer record.

MISSOURI Ph: 573-751-8343 New, used, boat, wholesale, manufacturers, motorcycle and trailer dealers are required to be licensed if they sell six or more vehicles/boats per year. Application, a bonafide place of business, dealer surety bond; criminal record check and registration fee must be submitted. Statement of insurance certification required. License expires December 31 annually.

MONTANA Ph: 406-846-6000 To apply for dealer license, franchised dealers must submit a copy of the franchise agreement from the manufacturer. All other dealers must submit license application. Applications are investigated prior to license issuance.

NEVADA Ph: 775-684-4690 Licensing Requirements – A license is required for each dealer. The license number varies by Dealer and License type. Fee $125.00 upon application, $50.00 upon renewal. Buying and Selling at Auctions - Out-of-state dealers may not buy and sell at auctions in Nevada without a Nevada dealer's license. Insurance - Any auto or garage liability minimum is required. NEW HAMPSHIRE Ph: 603-271-2330 Dealers must be licensed with the state. Prior to license issuance, applicants are investigated by an agency Inspector, and must also be approved by local authorities. License renewal is March 31, annu­ally.

Dealer classifications include New, Used, Junk, Repair, Transporter, Utility, Motorcycle and Wholesaler.

NEW JERSEY Ph: 609-292-4517 All new and used car dealers and leasing companies must be licensed. Applications for license are submitted to the Dealer's Unit, Business License Compliance Bureau. Dealer plates and registrations are available only from Trenton BLS. New car dealers must be franchised to sell new cars. Application packages include the application form, affidavit, signature card, application for fingerprints, and supplemental application form.

NEW MEXICO Ph: 888-683-4636 A dealer license is required for wholesalers, manufacturers, wreckers, distributors, new vehicle dealers, used vehicle dealers, house trailer and motorcycle dealers. An established place of business must be maintained and zoning and fencing requirements must be met. All dealers must have a display area except wholesaler. On-site inspection is conducted prior to license issuance.

Dealer license fees: Approximately $1,003 for a three year registration (includes one plate). Dealer plates are issued to be used for demonstration and delivery purposes. Personal use is also permitted.

New dealer must have pre-licensing education. Call Oregon Independent Automobile Dealers Association for the class at 1-800-447-0302. Dealers must have Bond, Lot Liability Insurance that also covers all vehicle use and local government approval of business location.

SOUTH CAROLINA Ph: 803-737-4000 State license is required for all new and used car dealers and camper/motorcycle dealers.

Issued for demonstration and delivery use only. New car dealers are not required to be franchised. Used car dealers may sell new cars.

SOUTH DAKOTA Ph: 605-773-3541 An individual in the business of selling or advertising sale of vehicles is considered a dealer and must be licensed. Dealer application requirements and renewal applications are filed through the County Treasurer . Investigation of the applicant and the described place of business are conducted by the state dealer inspector.

The place of business must be:

a) a commercial structure within the state of South Dakota , with a display area for five or more vehicles b) in accordance with building codes and zoning laws c) location where required books and records are kept d) the principal business at the location (cannot be the residence of the applicant).

TENNESSEE Ph: 615-741-2711 When an individual sells more than 5 vehicles during a calendar year, he is considered in business and must be licensed by the state as a dealer.

When applying for license, new vehicle dealers must sub­mit a franchise agreement.

New Vehicle Dealer License Fee: $200.00 for each branch upon application/renewal and each line-make authorized to sell. Used vehicle dealers may not sell new vehicles.

Used Vehicle Dealer License Fee: $200.00 upon application/renewal

A facility inspection is conducted for all dealers prior to li­cense issuance.

TEXAS Ph: 877-366-8887 Any person who is engaged in the business of buying, selling or exchanging motor vehicles, motorcycles, travel trailers or trailers/semi-trailers is required to obtain a dealer license. The Motor Vehicle Di­vision assigns a current valid, general distinguishing number for locations in each city municipality. The main exception is for a person who sells fewer than 5 vehicles in a calendar year, provided the vehicles are titled and registered in such person's name.

New Franchise Dealer License Fees: $175.00 franchise fee plus $500.00 for each required general dis­tinguishing number (motor vehicle, motor cycle, travel trailer, trailer/semi-trailer, wholesale and wholesale auction). Annual renewal fee is determined by number of cars sold in a calendar year ($175.00 - $750.00 for license plus $200.00 for each required general distinguishing number).

Used Car Dealer License Fee: $500.00 Used Car Dealer Renewal Fee: $200.00 per year for each general distinguishing number.

UTAH Ph: 801-297-7780 License is required for all dealers. A dealer is an individual selling or exchanging three or more new or used motor vehicles within a 12-month period. All applicants are investigated by the Motor Vehicle Enforcement Division. Form TC-300 lists all required forms.

VERMONT Ph: 802-828-2038 Dealers selling 12 or more cars in a year must be licensed. License renewals are on a staggered basis. A Dealer Audit is conducted by State In­spectors for approval of license renewal.

VIRGINIA Ph: 804-367-0901 Certification of Qualification required: each new dealer-operator and salesperson must pass written examination ($25.00 fee). If applicant is a dealer in new vehicles with factory warranties, a copy of service agreement with manufacturer or distributor is required. The dealer sales office must be inspected by a DMV investi­gator prior to issuance. Each dealer is assigned a permanent dealer code with up to five digits. Licenses are staggered, fees are prorated, each plate must be insured and all licenses expire on the last day of the designated month. Even though the franchise dealership sells used motor vehicles from the dealership, a used motor vehicle dealer license is not required for the franchise location. Besides a local business license, the franchise dealer will need to obtain a dealer registration number from the Department of Motor Vehicle Safety.

What is an “established place of business”?

An “established place of business” is defined in the Official Code of GA Annotated, O.C.G.A 43-47-2 (3), as “a salesroom or sales office in a building or on an open lot of a retail used car dealership or at which a permanent business of bartering, trading, offering, displaying, selling, buying, dismantling, or rebuilding wrecked or used motor vehicles or parts is carried on, or the place at which the books, records, and files necessary to conduct such business are kept. Each such place of business shall be furnished with a working telephone listed in the name of the licensee for use in conducting the business and shall be marked by an appropriate permanent sign as prescribed by the appropriate division under this chapter.”

How many vehicles can I sell in a year before I have to be licensed?

You may not sell any vehicles with the intent to make a profit before becoming a licensed dealer. O.C.G.A. 43-47-2 (17)(A) defines a used motor vehicle dealer as “any person who, for commission or with intent to make a profit or gain of money or other thing of value, sells, exchanges, rents with option to purchase, offers, or attempts to negotiate a sale or exchange of an interest in used motor vehicles or who is engaged wholly or in part in the business of selling used motor vehicles, whether or not such motor vehicles are owned by such person. A motor vehicle broker shall be deemed to be a used motor vehicle dealer or a used car dealer for the purposes of this chapter.”

I thought I could sell up to five vehicles in a year before I had to be licensed?

The “five cars per year” statement has been misinterpreted by many people. The origin of the “five car” phrase is the Used Motor Vehicle Dealers' and Used Motor Vehicle Parts Dealers' Registration Act. O.C.G.A. 43-47-2 (17)(A) states that “…the sale of five or more used motor vehicles in any one calendar year shall be prima-facie evidence that a person is engaged in the business of selling used motor vehicles.” This means that evidence indicating that a person has sold five or more used motor vehicles in any one calendar year can be used to show that the person is engaged in the unlicensed practice of used motor vehicle sales. This statement should be read in its context, and should not be misinterpreted to mean that a person may sell up to five vehicles in a year before becoming licensed.

Can I operate a used car dealership out of my home? Whether you can lawfully operate a used car dealership out of your residence will depend upon the requirements and restrictions of your local zoning ordinances. Even though you plan to operate from your residence, you must meet the requirements of an “established place of business”, as defined in the Used Motor Vehicle Dealers' and Used Motor Vehicle Parts Dealers' Registration Act. You should contact your city or county Planning & Zoning Office to determine if current regulations will allow you to operate the business from your residence. You should also ask if current regulations will allow you to erect a permanent sign at your residence to advertise your business as a used car dealership.

What is an “appropriate permanent sign”?

The sign used to advertise your business must be of a permanent nature, as opposed to a banner or one along the lines of a real estate sale sign. “Appropriate” is determined by the city or county regulations that detail the restrictions in signage in your area. You will need to discuss the restrictions with your local zoning or business license office.

How do I become a used car wholesaler?

The Used Motor Vehicle Dealer License allows a dealer to sell wholesale or retail. No distinctions are made between wholesalers and retailers on the license. The process for obtaining the license is detailed on the Information Sheet for Used Motor Vehicle Dealers.

One caution: Because the Used Motor Vehicle Dealer License allows a dealer to sell both wholesale or retail, Board Rule 681-1-.01 states that you may not use the word “wholesale” in the name of the business, or in any advertising.

I don’t want to set up a car lot. I just want to be a broker. How do I become a broker?

The Used Motor Vehicle Dealer License allows a dealer to sell from an established place of business. This established place of business can be a used car lot, or it can be an office from which used cars are brokered. The licensing requirements for a broker are the same as for a dealer with an open lot. Please refer to the Information Sheet for Used Motor Vehicle Dealers for the requirements.

Do I need a license to sell on the Internet?

You need a used motor vehicle dealer license to sell a vehicle, whether on an open lot, as a broker in an office suite, or on the Internet (O.C.G.A. 43-47-7). Even though you sell through a site on the Internet, you must still meet the requirements for an “established place of business”, as stated in O.C.G.A 43-47-2 (3) and Board Rule 681-6-.01. You must also meet the same requirements for bond and insurance as a dealer with an open lot. Refer to the Information Sheet for Used Motor Vehicle Dealers.

What type of license do I need to sell motorcycles or pull-behind trailers?

Motorcycles and non-motorized trailers do not meet the definition of “motor vehicle” or “car”, as defined in the Used Motor Vehicle Dealers' and Used Motor Vehicle Parts Dealers' Registration Act. O.C.G.A. 43-47-2 (7) defines “motor vehicle” or “car” as “…every vehicle which is self-propelled and required to be registered under the laws of this state, except trackless trolleys (which are classified as streetcars), airplanes, motorboats, motorcycles, motor driven cycles, or go-carts.” According to this code section, motorcycles and pull-behind trailers are exempted from the category of “motor vehicle” or “car”, and, consequently, the sales of motorcycles and pull-behind trailers are not regulated by the Used Motor Vehicle Dealer Board. The only requirement to buy and sell motorcycles or pull-behind trailers is to obtain a local business license and a dealer registration number from the Department of Motor Vehicle Safety.

Do I need a license to repossess automobiles?

You do not need a used motor vehicle dealer license to strictly repossess automobiles. You will need a used motor vehicle dealer license, if you begin buying and selling repossessed vehicles.

How many photographs do you require?

The photographs of your business must show the outside of the facility, to include the sign. Whether you will need to submit one photograph, or multiple photographs, will depend upon whether you can sufficiently show your place of business and your sign in one photograph. If your business is in a suite in an office complex, your photograph(s) must show your business listed on the marquee of the office complex, and your must submit photograph(s) of the suite door, indicating your signage on the door.

Can more than one dealership be licensed at the same location?

According to Board Rule 681-3-.05, joint used motor vehicle dealer operations may be conducted, provided licensees maintain a separate office, entrance, inventory, records, and files necessary to conduct business. Each licensee at the location must ensure that the business name in which the license is listed appears on all business documents and vehicles offered for sale by the licensee. Each licensee must also have the required signage and telephone listing in the business name.

When does a used car license expire?

All used motor vehicle dealer licenses are two-year licenses, expiring on March 31 of the even year. Licensed dealers will receive a renewal application approximately six weeks prior to the expiration date.

What is a “designee”?

The designee is the person named by a corporation, a limited liability company, or a partnership to be the responsible license holder for the business. The business can have only one license holder; therefore, the license is issued to the business with the designee as the license holder. The designee assumes full responsibility for the operations of the licensed dealership on behalf of the partnership, corporation, or limited liability company. A sole proprietorship does not name a designee, because the sole owner is the license holder for the business and is considered by the Used Motor Vehicle Dealer Board to be the responsible person for the operations of the licensed dealership. The designee can be an officer, if the dealership is owned by a corporation, a partner, if the business is owned by a partnership, or an employee of the business. The designee makes application for the used motor vehicle dealer license on behalf of the corporation or partnership. When the application is submitted, the designee must submit the certificate of completion of the pre-licensing seminar to prove that the designee completed the required seminar. Other officers or partners do not have to submit proof that they have attended, although they will be wise to attend. The fingerprint cards submitted must be for the designee.

What do I need to do if the designee of my business leaves?

You will need to submit a new Application for Used Motor Vehicle Dealer License, and you will need to check the block for Change of Designee. The complete application, including fees and required accompanying documents (See Information Sheet for Used Motor Vehicle Dealers), must be submitted. The only additional requirement for a change of designee is an original notarized letter from the previous designee, releasing the position of designee to the new person. If the previous designee is no longer available to provide the letter of release, then the president or secretary of the corporation or LLC, or a partner of the partnership, must submit a letter to authorize the change.

What licenses do I need to operate a used motor vehicle auction?

You will need to submit an Application for Used Motor Vehicle Dealer License and an Application for Auction Company License. You may also need to submit an Application for Auctioneer License, if you are not a licensed auctioneer, and you plan on auctioning the vehicles yourself. You must have a licensed auctioneer to conduct the auctions. Refer to the License Requirements for Auctioneer for further information on becoming a licensed auctioneer.

How do I change my dealership name or address?

You will need to complete the Request for Change of Location &/or Change of Name. Change of location requires photographs of the new location, including the sign, and a new certificate of liability insurance, which lists the new location address.

Change of name requires a new bond or bond rider, issued in the new name, a new certificate of liability insurance, listing the new name, and photographs of the business that reflect the name change on signage.

Caution: A change of business structure, such changing from a sole proprietorship to a corporation, limited liability company, or partnership, is not a name change. Rather, this type of change is the formation of a new and separate business entity. A name change request cannot be granted for such a change. When the business entity has changed, even if a corporation is dissolved and a new corporation is created, a new and complete Application for Used Motor Vehicle Dealer License must be submitted, including fees and all required documents.

I want to open a second location under the same dealership name. How do I do that? Submit an Application for Used Motor Vehicle Dealer License, and check the box for Supplemental License. The designee must be the same as for the original license. The accompanying documents will be required for this supplemental license application as was required for the original location’s license, with the exception of the proof of seminar completion and fingerprint cards. The same bond issued to the original location may be used for the supplemental, but a copy of the bond must accompany the supplemental application. The certificate of insurance must be amended to list the additional location. An original amended certificate must accompany the supplemental application.

How long does a dealer have after the sale of a vehicle to transfer the title to my name?

The dealer has 30 calendar days from the date of the sale to apply for a title in the purchaser’s name and to furnish the purchaser with the proper documents to obtain a tag for the vehicle.

It’s been over 30 calendar days, and I still do not have my title, and I can’t get a tag. What can I do?

· You should attempt to contact the dealer to demand the title. If you receive no satisfaction from the dealer, you may file an Official Complaint to the Georgia Board of Registration of Used Motor Vehicle Dealers. Keep in mind that the Board’s authority is limited to sanctions against a dealer’s license. The Board does not have the authority to get your title for you.

· You also may wish to seek legal counsel on your legal rights to pursue the possession of your title in court.

· If the dealer is licensed, or if the dealer has recently closed operations, you may request from the Board office a Letter of Certification, to include the bond information, on the dealer. Every dealer is required to obtain a $20,000 surety bond, issued in favor of the State of Georgia, to assist purchasers harmed by the dealer’s misrepresentations regarding liens against any used motor vehicle, or titles to any used motor vehicle. You can use the bond information to file a claim against the bond with the bond company.

· If the dealer is unlicensed, you may request from the Board office a Letter of Certification that indicates that the dealer is unlicensed. You will then need to follow the procedures of the Department of Motor Vehicle Safety to obtain a bonded title.

· If the dealer’s license has lapsed, you may access the License Verification page to search for the dealer license. Once you have found the dealer information, you can print the information that indicates that the dealer’s license has lapsed. You may then take this information to the Department of Motor Vehicle Safety and follow their procedures for obtaining a bonded title.

How can I know that a dealer is licensed and in good standing?

You can verify whether a dealer is licensed by accessing the License Verification page on our website. Every licensed used motor vehicle dealer in Georgia is listed on this site. Be sure to click on the link that reads, “Click here to search for a licensed professional entity,” since the license is issued in the business name. Follow the steps to search for the particular dealer in which you are interested. The information you receive will indicate the license number, the status of the dealer, the date the license was issued, the date the license expires, and if any public board orders exists.

I financed my car, and now my finance company has closed or merged with another company. I can’t find anyone to get my title. What can I do?

O.C.G.A. 43-47-2 (17)(A) states that “…the sale of five or more used motor vehicles in any one calendar year shall be prima-facie evidence that a person is engaged in the business of selling used motor vehicles.” This means that evidence indicating that a person has sold five or more used motor vehicles in any one calendar year can be used to show that the person is engaged in the unlicensed practice of used motor vehicle sales. This statement should be read in its context, and should not be misinterpreted to mean that a person may sell up to five vehicles in a year before becoming licensed.

Can I operate a used car dealership out of my home? Whether you can lawfully operate a used car dealership out of your residence will depend upon the requirements and restrictions of your local zoning ordinances. Even though you plan to operate from your residence, you must meet the requirements of an “established place of business”, as defined in the Used Motor Vehicle Dealers' and Used Motor Vehicle Parts Dealers' Registration Act. You should contact your city or county Planning & Zoning Office to determine if current regulations will allow you to operate the business from your residence. You should also ask if current regulations will allow you to erect a permanent sign at your residence to advertise your business as a used car dealership.

What is an “appropriate permanent sign”?

The sign used to advertise your business must be of a permanent nature, as opposed to a banner or one along the lines of a real estate sale sign. “Appropriate” is determined by the city or county regulations that detail the restrictions in signage in your area. You will need to discuss the restrictions with your local zoning or business license office.

How do I become a used car wholesaler?

The Used Motor Vehicle Dealer License allows a dealer to sell wholesale or retail. No distinctions are made between wholesalers and retailers on the license. The process for obtaining the license is detailed on the Information Sheet for Used Motor Vehicle Dealers.

One caution: Because the Used Motor Vehicle Dealer License allows a dealer to sell both wholesale or retail, Board Rule 681-1-.01 states that you may not use the word “wholesale” in the name of the business, or in any advertising.

I don’t want to set up a car lot. I just want to be a broker. How do I become a broker?

The Used Motor Vehicle Dealer License allows a dealer to sell from an established place of business. This established place of business can be a used car lot, or it can be an office from which used cars are brokered. The licensing requirements for a broker are the same as for a dealer with an open lot. Please refer to the Information Sheet for Used Motor Vehicle Dealers for the requirements.

Do I need a license to sell on the Internet?

You need a used motor vehicle dealer license to sell a vehicle, whether on an open lot, as a broker in an office suite, or on the Internet (O.C.G.A. 43-47-7). Even though you sell through a site on the Internet, you must still meet the requirements for an “established place of business”, as stated in O.C.G.A 43-47-2 (3) and Board Rule 681-6-.01. You must also meet the same requirements for bond and insurance as a dealer with an open lot. Refer to the Information Sheet for Used Motor Vehicle Dealers.

What type of license do I need to sell motorcycles or pull-behind trailers?

Motorcycles and non-motorized trailers do not meet the definition of “motor vehicle” or “car”, as defined in the Used Motor Vehicle Dealers' and Used Motor Vehicle Parts Dealers' Registration Act. O.C.G.A. 43-47-2 (7) defines “motor vehicle” or “car” as “…every vehicle which is self-propelled and required to be registered under the laws of this state, except trackless trolleys (which are classified as streetcars), airplanes, motorboats, motorcycles, motor driven cycles, or go-carts.” According to this code section, motorcycles and pull-behind trailers are exempted from the category of “motor vehicle” or “car”, and, consequently, the sales of motorcycles and pull-behind trailers are not regulated by the Used Motor Vehicle Dealer Board. The only requirement to buy and sell motorcycles or pull-behind trailers is to obtain a local business license and a dealer registration number from the Department of Motor Vehicle Safety.

Do I need a license to repossess automobiles?

How many photographs do you require?

The photographs of your business must show the outside of the facility, to include the sign. Whether you will need to submit one photograph, or multiple photographs, will depend upon whether you can sufficiently show your place of business and your sign in one photograph. If your business is in a suite in an office complex, your photograph(s) must show your business listed on the marquee of the office complex, and your must submit photograph(s) of the suite door, indicating your signage on the door.

Can more than one dealership be licensed at the same location?

According to Board Rule 681-3-.05, joint used motor vehicle dealer operations may be conducted, provided licensees maintain a separate office, entrance, inventory, records, and files necessary to conduct business. Each licensee at the location must ensure that the business name in which the license is listed appears on all business documents and vehicles offered for sale by the licensee. Each licensee must also have the required signage and telephone listing in the business name.

When does a used car license expire?

All used motor vehicle dealer licenses are two-year licenses, expiring on March 31 of the even year. Licensed dealers will receive a renewal application approximately six weeks prior to the expiration date.

What is a “designee”?

The designee is the person named by a corporation, a limited liability company, or a partnership to be the responsible license holder for the business. The business can have only one license holder; therefore, the license is issued to the business with the designee as the license holder. The designee assumes full responsibility for the operations of the licensed dealership on behalf of the partnership, corporation, or limited liability company. A sole proprietorship does not name a designee, because the sole owner is the license holder for the business and is considered by the Used Motor Vehicle Dealer Board to be the responsible person for the operations of the licensed dealership. The designee can be an officer, if the dealership is owned by a corporation, a partner, if the business is owned by a partnership, or an employee of the business. The designee makes application for the used motor vehicle dealer license on behalf of the corporation or partnership. When the application is submitted, the designee must submit the certificate of completion of the pre-licensing seminar to prove that the designee completed the required seminar. Other officers or partners do not have to submit proof that they have attended, although they will be wise to attend. The fingerprint cards submitted must be for the designee.

What do I need to do if the designee of my business leaves?

You will need to submit a new Application for Used Motor Vehicle Dealer License, and you will need to check the block for Change of Designee. The complete application, including fees and required accompanying documents (See Information Sheet for Used Motor Vehicle Dealers), must be submitted. The only additional requirement for a change of designee is an original notarized letter from the previous designee, releasing the position of designee to the new person. If the previous designee is no longer available to provide the letter of release, then the president or secretary of the corporation or LLC, or a partner of the partnership, must submit a letter to authorize the change.

What licenses do I need to operate a used motor vehicle auction?

You will need to submit an Application for Used Motor Vehicle Dealer License and an Application for Auction Company License. You may also need to submit an Application for Auctioneer License, if you are not a licensed auctioneer, and you plan on auctioning the vehicles yourself. You must have a licensed auctioneer to conduct the auctions. Refer to the License Requirements for Auctioneer for further information on becoming a licensed auctioneer.

How do I change my dealership name or address?

You will need to complete the Request for Change of Location &/or Change of Name. Change of location requires photographs of the new location, including the sign, and a new certificate of liability insurance, which lists the new location address.

Change of name requires a new bond or bond rider, issued in the new name, a new certificate of liability insurance, listing the new name, and photographs of the business that reflect the name change on signage.

Caution: A change of business structure, such changing from a sole proprietorship to a corporation, limited liability company, or partnership, is not a name change. Rather, this type of change is the formation of a new and separate business entity. A name change request cannot be granted for such a change. When the business entity has changed, even if a corporation is dissolved and a new corporation is created, a new and complete Application for Used Motor Vehicle Dealer License must be submitted, including fees and all required documents.

I want to open a second location under the same dealership name. How do I do that? Submit an Application for Used Motor Vehicle Dealer License, and check the box for Supplemental License. The designee must be the same as for the original license. The accompanying documents will be required for this supplemental license application as was required for the original location’s license, with the exception of the proof of seminar completion and fingerprint cards. The same bond issued to the original location may be used for the supplemental, but a copy of the bond must accompany the supplemental application. The certificate of insurance must be amended to list the additional location. An original amended certificate must accompany the supplemental application.


Complaints and Titles FAQs

How long does a dealer have after the sale of a vehicle to transfer the title to my name?

The dealer has 30 calendar days from the date of the sale to apply for a title in the purchaser’s name and to furnish the purchaser with the proper documents to obtain a tag for the vehicle.

It’s been over 30 calendar days, and I still do not have my title, and I can’t get a tag. What can I do?

· You should attempt to contact the dealer to demand the title. If you receive no satisfaction from the dealer, you may file an Official Complaint to the Georgia Board of Registration of Used Motor Vehicle Dealers. Keep in mind that the Board’s authority is limited to sanctions against a dealer’s license. The Board does not have the authority to get your title for you.

· You also may wish to seek legal counsel on your legal rights to pursue the possession of your title in court.

· If the dealer is licensed, or if the dealer has recently closed operations, you may request from the Board office a Letter of Certification, to include the bond information, on the dealer. Every dealer is required to obtain a $20,000 surety bond, issued in favor of the State of Georgia, to assist purchasers harmed by the dealer’s misrepresentations regarding liens against any used motor vehicle, or titles to any used motor vehicle. You can use the bond information to file a claim against the bond with the bond company.

· If the dealer is unlicensed, you may request from the Board office a Letter of Certification that indicates that the dealer is unlicensed. You will then need to follow the procedures of the Department of Motor Vehicle Safety to obtain a bonded title.

· If the dealer’s license has lapsed, you may access the License Verification page to search for the dealer license. Once you have found the dealer information, you can print the information that indicates that the dealer’s license has lapsed. You may then take this information to the Department of Motor Vehicle Safety and follow their procedures for obtaining a bonded title.

How can I know that a dealer is licensed and in good standing?

You can verify whether a dealer is licensed by accessing the License Verification page on our website. Every licensed used motor vehicle dealer in Georgia is listed on this site. Be sure to click on the link that reads, “Click here to search for a licensed professional entity,” since the license is issued in the business name. Follow the steps to search for the particular dealer in which you are interested. The information you receive will indicate the license number, the status of the dealer, the date the license was issued, the date the license expires, and if any public board orders exists.

I financed my car, and now my finance company has closed or merged with another company. I can’t find anyone to get my title. What can I do?
